Is auto dialing illegal? The short answer

No. Auto dialing is legal in most countries, but sales calls are regulated: who you may call, with what consent, and whether a recorded voice may play all depend on the country. AutoDial CRM is an auto dialer app that places live calls from your own SIM. This page is general information, not legal advice.

Regulators rarely target the act of dialing a list with software. Their attention goes to three things. First, people who have said no: most of the countries below run a register where people can refuse sales calls, and callers are expected to respect it. Second, recorded messages: a sales call that plays a recording instead of a person usually needs stronger permission than a live call. Third, silent or dropped calls, which happen when a system rings more people than it has agents free. A dialer that connects one live person at a time, from a number the person can see, avoids the second and third problems by design. The first one, whom you call, remains a decision for you and your list.

Auto dialing rules in India

India’s rules on promotional calls and messages are set by TRAI, the telecom regulator, under its framework for unsolicited commercial communication. The current regulations are the Telecom Commercial Communications Customer Preference Regulations, 2018, as listed on TRAI’s own page. People record their preferences, including do-not-disturb choices and consents, through their telecom operator’s app or website, and TRAI also offers a DND app. TRAI has directed operators to set up a registration system for commercial voice calls as well as SMS. In practice, a business making promotional calls should check how its calls are classified and registered with its operator, and treat a person’s DND choice as a refusal unless that person has consented.

Auto dialing rules in the US

In the United States, sales calls fall under the TCPA, a federal law enforced through FCC rules, and under the FTC’s National Do Not Call Registry. The FTC explains that the registry is meant to stop sales calls from companies that follow the law, and that a company may still call when the person has recently done business with it or has given written permission. A company must stop if asked. Sales calls that play a recording are illegal without the person’s written permission, whether or not their number is on the registry. Individual states add rules of their own.

Auto dialing rules in the UK and EU

UK guidance from the ICO says live marketing calls must not go to anyone who has objected, or to numbers on the Telephone Preference Service unless that person has specifically agreed. Call lists should be screened against the TPS and, for business numbers, the Corporate TPS, and callers should identify themselves and show a number. Automated calls that play a recorded message need consent that covers automated calls specifically; general marketing consent is not enough. Across the EU, marketing calls are governed by EU privacy law together with each member state’s own telecom rules, so the details differ from country to country; your national data protection authority is the place to check.

Auto dialing rules in the UAE and Australia

In the UAE, TDRA, the telecom regulator, runs a policy against intrusive marketing messages and says it takes strict action against senders who lack prior consent; check its current guidance and your operator’s terms for marketing calls as well. Australia has a national Do Not Call Register overseen by the communications regulator, ACMA, and businesses calling Australian numbers for marketing are expected to respect it.

  1. Write down where each lead came from: your form, an enquiry, a referral or a bought list.
  2. Check the do-not-call register of each country you call into.
  3. Keep your own list of people who asked not to be called, and honour it on every campaign.
  4. Use a live caller; avoid recorded sales messages unless you hold the specific consent required.
  5. Show a real number and say who you are at the start of the call.

Auto dialing rules: how AutoDial CRM helps

AutoDial CRM keeps a person on every call and dials from the caller’s own SIM or WhatsApp, one call at a time per phone, so no one answers to a recording or to silence. Numbers added to the excluded list stay out of backup and every automation, and the block list stops calls from numbers you never want to hear from. Lead source tags show where each person came from, which helps when you need to show how a lead reached you. For teams calling bigger lists, the bulk calling app and telecaller app pages describe the daily workflow. The app does not check numbers against any national register for you.

Auto dialing rules: limits of this guide

This page is general information, not legal advice. It summarises regulator pages as read on 14 October 2026, rules change, and each country has detail and exceptions not covered here. For a real campaign, read the regulator’s current guidance and speak to a lawyer in the country you call into.

Auto dialing rules example

An illustration, not a named customer. A home loan agent in Ahmedabad, India, gets about 80 leads a month from her own website form. Before calling, she tags each lead with its source, keeps a short list of people who asked not to be called again, and calls only people who filled in the form, from her own mobile number, with a live conversation every time.

FAQ

Is auto dialing legal FAQ

  1. Is an automatic dialer legal?

Yes, an automatic dialer is legal to own and use in most countries. What the law restricts is the campaign: calling people who opted out, calling without consent where it is required, or playing recorded sales messages. This is general information, not legal advice.

  2. Is cold calling legal in India?

Yes, cold calling is not banned in India, but promotional calls fall under TRAI's commercial communication rules, which let people record their preferences and consents through their telecom operator. Check TRAI's current rules before calling numbers that have not asked to hear from you.

  3. Do do-not-call rules cover business phone numbers?

Sometimes, yes: calling businesses is generally allowed, but some countries protect business numbers too. In the UK, the ICO tells callers to screen business call lists against both the TPS and the corporate CTPS register.

  4. How to block auto dialers?

Register your number on your country's do-not-call list and turn on spam blocking on your phone. In India that is done through your operator or the TRAI DND app, in the US through DoNotCall.gov, and in the UK through the TPS; AutoDial CRM users can also block numbers and see spam flags from other users' reports.

  5. Are robocalls the same as auto dialing?

No, a robocall plays a recorded message, while auto dialing can simply connect a live person to each number. Recorded sales calls face stricter rules: the FTC says they need the person's written permission in the US, and the ICO says UK automated calls need consent that covers them specifically.

  6. What is the TCPA?

The TCPA, the Telephone Consumer Protection Act, is the US federal law that limits telemarketing calls, calls made with automated dialing equipment and prerecorded messages. The FCC writes and enforces the rules under it, and the FTC runs the National Do Not Call Registry.

  7. Do I need consent before calling a lead with an auto dialer?

Often yes, depending on the country and on whether a recording plays. A person who filled in your form or asked for a call is in a different position from a bought list, so keep a record of how each lead reached you.

  8. Can I auto dial numbers on the DND list in India?

Generally not for promotional calls, unless that person has given you consent, because DND exists so people can refuse promotional communication. Transactional and service calls are treated differently, so read TRAI's current rules for your case.

  9. What is the best auto dialer for staying within calling rules?

The best auto dialer for careful calling keeps a live person on every call, shows a real number, and lets you keep chosen numbers out of every list. AutoDial CRM calls from your own SIM, never plays recorded sales messages, and has an excluded numbers list and a block list.

  10. Is AutoDial CRM legal to use for sales calls?

Yes, AutoDial CRM is a lawful calling tool; whether a particular campaign is lawful depends on who you call and the rules where they live. It places live calls from your own number one at a time, which avoids the recorded-message and silent-call problems that regulators focus on.

  11. How much does an auto dialing app cost with AutoDial CRM?

AutoDial CRM costs ₹299 per user a month billed every 3 months (₹897), or ₹199 per user a month billed yearly (₹2,388). In US dollars that is $3.79 or $2.79 per user a month.

Your next call is ringing.

Install AutoDial CRM, import your leads and let the dialer, the WhatsApp and the follow-up alarm do the remembering.
